1. CHANGES TO VOLUNTARY ACTIVE SERVICE RETIREMENT TIME IN GRADE REQUIREMENTS (FOR MAJORS) FROM THE REPEAL AND REENACTMENT OF SECTION 1370, TITLE 10, UNITED STATES CODE, 14 JUN 21. Although over a year old, this memo is being announced as many are not aware of this change. This memorandum is notification of the repeal and reenactment of section 1370, Title 10, United States Code (10 USC 1370), which became effective 1 January 2021.The provisions of the new 10 USC 1370 significantly changed the service time in grade requirement for an officer in the grade of major to voluntarily retire in the highest grade served satisfactorily from active service. Previously, majors only needed six months time in grade for voluntary retirement. Subparagraph (b)(1) of 10 USC 1370 now states that in order to be eligible for voluntary retirement in a grade above captain an officer must have served for a period of not less than three years. Therefore, majors now need at least three years time in grade in order to retain the rank of major when voluntarily retiring. The Secretary of Defense has delegated authority to the Secretary of the Army to reduce (waive) the time in grade requirement to not less than two years. This authority cannot be further delegated.
