2. Purpose. This directive delegates authorities to the Director, U.S. Army Criminal
Investigation Division (USACID) in addition to those addressed in reference 1b.
3. Applicability. This policy applies to the Regular Army, Army National Guard/Army
National Guard of the United States, and U.S. Army Reserve.
4. Policy.
a. The Director, USACID is authorized to establish a program to use Department of
the Army personnel as confidential informants and cooperating witnesses in support of
criminal investigations and operations. The program will be codified in an appropriate
USACID regulation. The Director, USACID may delegate approval authority for the use of
Army personnel as confidential informants and cooperating witnesses, but not below the
level of Resident Agent-in-Charge (RAC) or Assistant Special Agent-in-Charge (ASAC).

b. To enable the Director, USACID to exercise direction and control over USACID
as an independent military criminal investigative organization, Army commands,
activities, and personnel will comply with USACID requests for information and
assistance pursuant to an authorized investigation or operation, including providing
access to installations, information, personnel, and records.
c. The Provost Marshal General is designated a Show Cause Authority for all
military personnel assigned or attached to USACID.
5. Proponent. The Under Secretary of the Army is the proponent for this policy,
responsible for coordinating with the Provost Marshal General to incorporate the
provisions of this directive in AR 195–2, AR 195–3, and AR 195–6, and with the Deputy
Chief of Staff, G-1 to incorporate its provisions in AR 600–8–22 and AR 600–8–24,
within 2 years of the date of this directive.
6. Duration. This directive is rescinded on publication of the revised regulations.
